Zhang v. Canada (Citizenship and Immigration), 2018 CanLII 102105 (CA IRB)

The Immigration Appeal Division allowed the appeal of a refused Spousal Sponsorship application, as the Board Member found that the Appellant’s marriage to the applicant was genuine and was not entered into primarily for the purpose of acquiring any status or privilege under the Immigration and Refugee Protection Act.

Judicial Review granted by the Honourable Mr. Justice Zinn of the Federal Court, due to an error by an immigration officer assessing the Applicants' case. The immigration officer failed to properly assess the evidence presented in the Applicants' case.

X (Re), 2016 CanLII 107228 (CA IRB)

Appeal granted by a Board Member at the Refugee Appeal Division, as the Board Member at the Refugee Protection Division had engaged a microscopic analysis of evidence which were not material to the claim, and unreasonably ignored sworn testimony and supporting evidence provided by the Appellants.
